History

The Court of Appeal in Equity of Prince Edward Island was constituted in legislation in 1869 as the appeal court for the Court of Chancery. The 1869 legislation contemplated procedural orders but as it appeared none had been made and the Court had never met, legislation was passed in 1883 to remedy this defect. The Appeal in Equity Act, 1883, Cap. 6 provided for the operation of the court although the first sittings of the Court do not appear to have taken place until 1888.
